On 15th July two students, Abel and Alex, newly elected as Sabbatical Officers of SOAS Students’ Union and members of SOAS UNISON, were emailed letters terminating their employment contracts. These letters were timed to arrive on their first day of work, completely out of the blue. These are two democratically elected employees, appointed by the student body.
While we cannot discuss a number of details regarding the ongoing cases, the manner in which the terminations were carried out sets a disturbing precedent which is of immediate concern to many staff across the school and to students.
The decision to terminate, signed off by the SU Board of Trustees, was reached without any due process of any kind. Abel and Alex were unaware that there were any accusations even being considered, much less that they were facing such a harsh sanction.
ACAS guidance was not followed: we know of no investigation to establish any facts. Neither Alex or Abel, nor their union was informed of any problem; the first time any accusations were revealed was in the termination letter. There’s been no disclosure of evidence, only untested assertions that purport to be facts. There was no disciplinary hearing; the meeting where the cases appear to have been heard was a Board of Trustees meeting, to which neither of the two were invited; they had not even been told that the Board was considering their termination. There was also no gross misconduct charge, yet they were told termination is immediate, and not to come back.
Some student staff may not be aware that all disciplinary processes must follow guidance set out by ACAS to be considered fair, or that they can join a union to collectively assert their rights when things go wrong. Whether staff are unaware is no excuse for any employer to ignore ACAS. As trade unions in HE we will fight for student staff as we do for any staff, to have a voice and make sure no one of our community is exploited, discriminated, bullied, unfairly or wrongfully dismissed.
It will no doubt be disturbing to many people that such poor treatment of student employees would come from the trustees of SOAS Students’ Union, a registered charity. The responsibilities of employers are clear and accessible, but they have not been practised in this case.
Freedom of Expression
It is notable that both students have been outspoken on the Palestinian struggle, and have been active supporters of the SOAS Liberation Zone.
It’s also notable that they had stood for election to lead the Students’ Union on manifestos that called for changes in the way the SU is run. They were elected by the student body. The result of the drastic and sudden action taken behind closed doors by the Board is that they are now blocked from taking up their elected roles as officers and SU Trustees, and are left unemployed.
Action
UNISON has written to the SU Board of Trustees setting out the serious deficiencies in their process, calling for withdrawal of the termination letters. The Board must act on this immediately so that all employees of the SU can be confident that none will ever again be put through such a shocking and unfair attack on their job, their livelihood.
Staff and students can register their concerns by writing to the SU Board of Trustees, and take a stand against injustice by petitioning, and by following the ongoing campaigns, meetings and actions of SOAS UNISON, SOAS UCU and SOAS Justice For Workers.
El 15 de julio, dos estudiantes, Abel y Alex, recién elegidos como oficiales sabáticos de la Unión de Estudiantes de SOAS y miembros del unísono de SOAS, fueron enviadas por correo electrónico cartas que terminaron sus contratos de trabajo. Estas cartas fueron programadas para llegar a su primer día de trabajo, completamente de la nada. Estos son dos empleados elegidos democráticamente, designados por el cuerpo estudiantil.

No se siguió la orientación de ACAS: no conocemos ninguna investigación para establecer ningún hecho. Ni Alex ni Abel, ni su unión fueron informados de ningún problema; La primera vez que se reveló cualquier acusación fue en la carta de terminación. No ha habido divulgación de evidencia, solo afirmaciones no probadas que pretenden ser hechos. No hubo una audiencia disciplinaria; La reunión donde los casos parecen haber sido escuchados fue una reunión de la Junta de Síndicos, a la que ninguno de los dos fue invitado; Ni siquiera les habían dicho que la junta estaba considerando su terminación. Tampoco había un cargo de mala conducta bruta, sin embargo, se les dijo que la terminación es inmediata, y no volver.
Es posible que algún personal estudiantil no sea consciente de que todos los procesos disciplinarios deben seguir la orientación establecida por ACAS para ser considerados justos, o que pueden unirse a un sindicato para afirmar colectivamente sus derechos cuando las cosas salen mal. Si el personal desconoce no es una excusa para que ningún empleador ignore las ACA. Como los sindicatos en HE lucharemos por el personal estudiantil como lo hacemos por cualquier personal, tener una voz y asegurarnos de que nadie de nuestra comunidad sea explotado, discriminado, intimidado, injustamente o injustamente descartado.
Sin duda será inquietante para muchas personas que un trato tan pobre de los empleados estudiantes proveniría de los fideicomisarios de la Unión de Estudiantes de SOAS, una organización benéfica registrada. Las responsabilidades de los empleadores son claras y accesibles, pero no se han practicado en este caso.
Libertad de expresión
Es notable que ambos estudiantes hayan sido franco en la lucha palestina y hayan sido partidarios activos de la Zona de Liberación SOAS.
También es notable que hayan defendido las elecciones para liderar la Unión de Estudiantes en los manifiestos que requerían cambios en la forma en que se ejecuta el SU. Fueron elegidos por el cuerpo estudiantil. El resultado de las medidas drásticas y repentinas tomadas a puerta cerrada por la junta es que ahora están bloqueados de asumir sus roles elegidos como oficiales y fideicomisarios de SU, y quedan desempleados.
Acción
Unison ha escrito a la Junta de Síndicos de SU que establecen las deficiencias graves en su proceso, pidiendo el retiro de las cartas de terminación. La Junta debe actuar sobre esto de inmediato para que todos los empleados del SU puedan estar seguros de que ninguno volverá a pasar por un ataque tan impactante e injusto en su trabajo, su sustento.
El personal y los estudiantes pueden registrar sus inquietudes escribiendo a la Junta de Síndicos de SU y tomar una posición en contra de la injusticia mediante la solicitud, y siguiendo las campañas, reuniones y acciones de SOA unísonas, SOA UCU y SOAS Justice for Workers.
